Terms and conditions

1. Scope

1.1. This document governs the contractual relationship between the patient (the “Patient”) who requests a consultation via the form on the site (the “Site”) and Dr. Whisstock (the “Professional”) chosen by the Patient for a professional service (the “Consultation”).

1.2. The Patient acknowledges and accepts that the validity of this Agreement is subject to the acceptance by the Professional of the Consultation request.

1.3. The Patient is required to periodically consult the Terms and Conditions of the Service to check for any changes. The use of the Site following the publication of changes will constitute acceptance of these changes by the user.

1.4. On this Site the Professional offers medical information relating to her specialities, telemedicine and booking services at clinics where she works.

1.5. The Site does not represent a newspaper as it is updated without any periodicity. It cannot, therefore, be considered an editorial product pursuant to law n ° 62 of 7.03.2001.

2. Use of the site

2.1. The Site may be used only for personal purposes and for uses permitted by law, which prohibits the following:

  • entering incomplete, false and inaccurate personal information and, more generally, falsifying one’s identity,
  • use of personal information exchanged between Professional and Patient (emails, prescriptions, reports, video consultation) for sharing or publication on social networks,
  • use of any script or software that may interfere with the functionality of the Site or with any activity conducted on the Site itself,
  • in general, attempts to violate the security system of the Site.

2.2. The fraudulent use of the telemedicine service is expressly prohibited, especially in cases where the aforementioned service is concluded in one’s own name for third parties, providing information and symptoms of persons not associated with the applicant’s condition – except in the case of medical examinations for minors or specifically authorised by third party. In this case, the applicant will be solely responsible for any damage suffered by the person in the name and on whose behalf the medical examination by the doctors, or by the facility providing the service, was requested.

2.3. The competent Authorities will be informed of any conduct that could result in violation of criminal or civil laws and, where required, it will be possible to cooperate with the Authorities in prosecuting the users involved in such violations.

3. Material

3.1. The text, graphics, logos, part of the images and any other material on the Site benefit from legal protection pursuant to Italian and international laws and regulations on intellectual and industrial property. Unauthorized use of this material may, therefore, constitute a violation of the legislation on intellectual property. Some images posted on this Site are taken from free sources on the Internet and, therefore, considered to be in the public domain: if their publication violates any copyright, please communicate it through the appropriate form – the offending material will be removed immediately.

3.2. The user who accesses the Site is not authorised to sell, modify, reproduce, exhibit, publicly use, distribute, or otherwise use the material in any other way, for commercial or public purposes.

3.3. The articles offered through the site are of an exclusively informative nature for users, therefore all contents or information provided in no case replace the judgment of a medical professional or the possible need for an individual medical examination in reference to a specific case. In any case, if the user believes there is a medical emergency, he / she must immediately contact a medical professional or contact the nearest available emergency service as quickly as possible.

4. Services and methods of supply

4.1. The Site offers the possibility of requesting a medical examination with the Professional at one of the medical facilities in which she serves, either by telephone or by filling in a booking request form for one of the aforementioned facilities. In this case, the Patient’s information will be sent directly to the chosen facility, which will independently manage the booking process by contacting the applicant.

4.2. The Site offers the possibility of requesting a medical consultation in telemedicine with the Professional, which will take place through a secure video-conference platform. With this service, the Patient can obtain a first medical orientation, which in no case will be considered a diagnosis since this would require a physical examination, impossible via a tele-visit, chat or email.

5. Duration

5.1. This Agreement is valid and effective from the date of confirmation by the Professional of taking charge of the Consultation request, under the conditions and terms indicated in this Agreement, and until the date on which the Professional has provided the Consultation to the Patient.

6. Fees and right of withdrawal

6.1. The Patient who intends to make use of the medical facilities where the Professional operates, will agree with them the date of the visit and the cost. The entire management report of the visit is entrusted to the structure itself and the Professional will take care only of its completion.

6.2. The patient who intends to make use of medical consultation through telemedicine undertakes to pay the Professional in advance the fee agreed from time to time by email through one of the traceable forms of payment that will be indicated. The telemedicine consultation can take place only after the amount has been credited to the Professional’s bank account.

6.3. The Patient has the right to withdraw from the telemedicine consultancy contract, without indicating the reasons, within 14 days of confirming the Consultation request. The withdrawal period expires after 14 (fourteen) days from the conclusion of the contract, or after 14 (fourteen) days from the confirmation of the Consultation request. To exercise the right of withdrawal, the Patient is required to inform the Professional, via the website form or to the email address communicated during the booking process.

6.4. If the Patient promptly withdraws from the contract (or from the consultation request), the Patient will not incur any costs and will be fully reimbursed of any amounts prepaid.

6.5. The Patient acknowledges and accepts that if he / she exercises the right of withdrawal after having asked the Professional to start providing the service during the withdrawal period of 14 days, the Professional may ask the Patient to pay reasonable costs in proportion to the part of Consultation already provided before the date of communication of the withdrawal. To this end, the Patient acknowledges and accepts that sending his / her medical documentation to the Professional, or any request that requires a preventive analysis by the Professional herself, will be equivalent to his / her own request to start the consultation during the 14-day withdrawal period.

6.6. The Patient is informed that the right of withdrawal is excluded (pursuant to art. 59 let. a) of the Consumer Code) when the purchased Consultation has already been closed by the Professional, the service being completed, even if the deadline 14 (fourteen) days from the conclusion of the contract has not yet expired.

7. Liability

7.1. The responsibility of the Professional towards the Patient in relation to the Consultation provided to the Patient is governed by the provisions of the Civil Code and by the applicable legislation on the conduct of the medical profession.

8. Privacy and protection of personal data

8.1. The Patient is requested to view the Privacy Policy on the Site before sending any personal data.

9. Applicable law and competent court

9.1. This Contract is governed by the laws of the Italian Republic. The Patient requesting a Consultation as a consumer has the rights referred to in Chapter I of Title III of Part III of the Consumer Code (Legislative Decree 205/2006).

9.2. Any dispute arising from this Agreement, or in any case relating to it, is the exclusive jurisdiction of the Court of Padua (Italy).
